Privacy Policy

1. Data Controller

2. Purposes and Legal Basis

  • Contact form – responding to your enquiry (Art. 6(1)(b) GDPR).
  • Booking and rental agreement – concluding and performing the contract, including issuing pro-forma/VAT invoices and processing payments (Art. 6(1)(b) GDPR), and accounting/tax obligations (Art. 6(1)(c) GDPR).
  • Check-in registration form – identity document data (type, number), date of birth, and name of the main tenant, collected to fulfil the statutory guest-registration obligation and to enable access to the apartment (Art. 6(1)(b) and (c) GDPR).
  • Door access code – phone number used to deliver a temporary door code by SMS, valid only for the duration of the stay (Art. 6(1)(b) GDPR).
  • Marketing – with your explicit consent (Art. 6(1)(a) GDPR), until withdrawn.

3. Retention Period

Contact form data – until the enquiry is answered, no longer than 12 months. Rental and invoice data – 5 years from the end of the invoice year (tax obligation). Check-in registration data (identity document, date of birth) – for the duration of the stay plus 12 months, unless specific legislation requires a longer period. Door access code – deleted automatically once the stay ends. Marketing data – until consent is withdrawn.

4. Recipients of Data

Personal data may be shared with the following categories of recipients, only to the extent necessary for the purposes below:

  • OVH SAS (hosting and email provider) – servers located within the European Union (France).
  • PayPro SA (Przelewy24) (online payment processing) – payment card and transaction data, as described in the Terms of Sale.
  • SMSAPI.pl (SMS service provider) – phone number, solely to deliver the door access code and booking-related reminders.
  • Tuya Inc. (and its Tuya Cloud platform) – data necessary to generate and revoke temporary door lock access codes (code number, validity date range). The server selected for this service is located in the European region; however, due to the global nature of the provider's infrastructure, incidental processing of data outside the EEA cannot be excluded – in such cases, appropriate legal safeguards under data protection law apply (standard contractual clauses).
  • IT software and service providers – to the extent necessary for the technical operation of the website and booking system.

6. Security of particularly sensitive data

Identity document data collected via the check-in registration form is processed with enhanced security measures and used only to the extent and for the time necessary to fulfil the registration obligation. The document number and series are not shared with any recipients other than those listed in section 4.

7. Cookies and similar technologies

This website uses only technically necessary mechanisms, which under Polish law do not require consent: a PHP session cookie (booking form handling, deleted when the browser closes) and browser local storage (localStorage) remembering the selected site language. This website does not use analytical, advertising or tracking cookies.

Terms of Sale

1. Definitions

Seller – Iwona Szponar, ul. Marszałka Piłsudskiego 10, 88-300 Mogilno, Poland, VAT: 557-161-24-95, REGON: 362162127. Client – a natural person, legal entity or organisational unit making a Reservation. Apartment – a furnished residential unit at Stara Cukrownia Jawor, ul. Starojaworska 104b, 59-400 Jawor, Poland. Reservation – an order for a stay in an Apartment for specific dates. Third-party Platform – an intermediary booking service (e.g. Booking.com, Airbnb) through which the Client may make a Reservation on terms set by that platform, in addition to these Terms.

2. General Provisions

Contact: nocleg@cukrownia-jawor.pl, tel. +48 609 890 170. These Terms govern reservations and short- and long-term rental of Apartments at Stara Cukrownia Jawor. Only an adult (18 years or older) with full legal capacity, or a legal entity/organisational unit represented by a duly authorised person, may make a Reservation. Reservations are made via the website form, by phone, or through a Third-party Platform, on the terms set by that platform in addition to these Terms.

3. Scope of Services

The Seller offers furnished Apartments for accommodation of employees and private individuals, for a minimum stay of 3 nights. Full description, amenities and pricing for each Apartment are available on the respective Apartment pages. The maximum number of guests for a given Apartment is stated in its description and may not be exceeded without the Seller's prior consent. Smoking is strictly prohibited in the Apartments — breaching this ban will result in a charge of 500 PLN to cover de-odorising and specialist cleaning costs, in addition to any liability for other damage (§5). Small pets, kept in a crate/carrier and weighing up to 10 kg, are permitted for an additional fee of 50 PLN per night. The Client remains fully responsible for the pet throughout the stay.

4. Contract Formation and Payment

The contract is concluded once the Seller confirms the Reservation and payment is made (or, for Third-party Platforms, according to that platform's rules). Currently accepted payment methods directly with the Seller: bank transfer based on a pro-forma invoice, or BLIK sent directly to phone number +48 609 890 170. Card payment and BLIK via Przelewy24 (PayPro SA) will be enabled at a later date. The total price, including all fees, is shown before the Reservation is made. Payment based on a pro-forma invoice must be made within a maximum of 2 business days of receiving it — or, if the arrival date falls earlier than that deadline, no later than the day of arrival. If BLIK to phone number is chosen, payment must be completed within 15 minutes of making the booking, otherwise the reservation will be automatically cancelled. Handover of keys / release of the remote door lock takes place only after payment to the Seller's account has been confirmed. Issuing the pro-forma invoice requires the Client's address details, provided in the booking form. The Client may additionally request a VAT invoice issued to a company, by providing its full name and VAT/Tax ID. Prices offered by the Seller on its own website are not lower than prices for an equivalent Apartment and dates offered via Third-party Platforms on which the Seller sells.

5. Security and Damages

The Seller does not charge a cash deposit and does not place any advance hold on the Client's card. Once payment for the stay has been made by card via Przelewy24, the Seller retains the ability to charge the same card an additional amount after the stay ends — only in a documented case of damage exceeding normal wear — using the card reference number made available through the Przelewy24 system (the Recurring Payment mechanism). The Seller will notify the Client of any damage claim within 14 days of the end of the stay, together with justification and cost estimate. The Client has the right to respond to the claim within 48 hours of receiving it — no response within that time is treated as no objection to the claim. Damage rules do not cover normal wear and tear of the Apartment.

6. Cancellation

The Client may cancel the Reservation with the following deductions: 0% if cancelled 7 or more days before arrival, 25% if cancelled 3–6 days before arrival, 50% if cancelled 0–2 days before arrival or in case of no-show. In the event of a Force Majeure Event (§7) preventing the stay, none of the above fees will be charged to the Client, and any payments made will be refunded in full.

7. Force Majeure

A Force Majeure Event means extraordinary circumstances beyond the control of either Party that could not have been foreseen or prevented, in particular: natural disasters, fire, flood, epidemics, acts of war, riots, acts of terrorism, decisions of public authorities preventing the stay, and other similar events affecting many Clients at once. In the event of a Force Majeure Event, neither Party shall be liable for failure or improper performance of obligations under the contract, to the extent that such performance became impossible as a result of such event. The Party invoking a Force Majeure Event must promptly inform the other Party of its occurrence.

8. Right of Withdrawal

Under Polish consumer law (Art. 38(12) of the Consumer Rights Act), the right of withdrawal from a distance contract does not apply to accommodation services with a specified performance date (specific stay dates). Business clients are not entitled to this right by law.

9. Complaints

Complaints may be submitted to nocleg@cukrownia-jawor.pl or by phone. The Seller responds within 14 days of receipt. A Client who is a consumer residing in the European Economic Area is entitled to use the EU Online Dispute Resolution platform, available at: ec.europa.eu/consumers/odr.

10. Payment Processing

Online payments are processed by PayPro SA (Przelewy24), based in Poznań at ul. Pastelowa 8, 60-198 Poznań, Poland, registered with the National Court Register (KRS) under number 0000347935, VAT (NIP) 7792369887, registered as a national payment institution with the Polish Financial Supervision Authority (KNF) under number UKNF IP24/2014.

11. Third-party Platforms

The Seller may make its Apartments available for booking via Third-party Platforms (e.g. Booking.com, Airbnb). For a Reservation made via a Third-party Platform, in addition to these Terms, that platform's own terms apply to the extent they govern the matter (in particular payment, cancellation and complaint rules at the intermediary stage). The Apartment rental contract is always concluded directly between the Seller and the Client — the Third-party Platform acts solely as an intermediary in the booking process.

12. Personal Data

Personal data processing is governed by a separate Privacy Policy.

13. Final Provisions

Matters not covered by these Terms are governed by the Polish Civil Code and the Consumer Rights Act. These Terms and any contracts concluded under them are governed by Polish law. Disputes shall be resolved by the court having jurisdiction under the Polish Code of Civil Procedure. If any provision of these Terms is found invalid or ineffective, this does not affect the validity of the remaining provisions. The Seller reserves the right to amend these Terms. Changes take effect 14 days after being published on the website. Reservations confirmed before the changes take effect remain subject to the rules in force on the day of their confirmation.

Book online

Fill in the form to reserve a date. Payment currently works via bank transfer — either a pro-forma invoice or BLIK to a phone number. Card payment is coming soon.

Minimum stay: 3 nights. Rate for the whole apartment/night (not per person), decreasing with length of stay: from 320 PLN (3-6 nights) to 180 PLN (44+ nights). Standard cleaning included in the price. No cash deposit and no advance card hold — an additional card charge is only possible after the stay ends, in a documented case of damage (see Terms of Sale).
